By accessing or using Eyes Up (“the Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you may not use the Service. These Terms apply to all users, including team administrators, coaches, players, and visitors.

Eyes Up is a team wellness platform that aggregates sleep and readiness data to provide insights for college football teams and their coaching staff. The Service includes:

• • Integration with wearable devices (e.g., Oura Ring)
• • Sleep score tracking and visualization
• • Team dashboards and analytics
• • Gamification features (leaderboards, pods)
• • Communication tools for coaches and players

You agree NOT to:

• • Use the Service for any unlawful purpose
• • Share login credentials with others
• • Attempt to access data belonging to other teams or users
• • Interfere with or disrupt the Service
• • Use automated systems to access the Service without permission
• • Misrepresent your identity or affiliation

5. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your data.

6. Team and Organization Terms

If you are using Eyes Up on behalf of a team or organization:

• • You represent that you have authority to bind the organization to these Terms
• • The organization is responsible for its users' compliance with these Terms
• • Team administrators are responsible for managing user access and permissions
• • Billing and subscription terms are determined by the organization's agreement with Eyes Up

7. Intellectual Property

The Service and its original content, features, and functionality are owned by Eyes Up Football and are protected by international copyright, trademark, and other intellectual property laws. You may not copy, modify, or create derivative works based on the Service without our express permission.

Eyes Up integrates with third-party services (e.g., Oura). Your use of these integrations is subject to the third party's terms and privacy policies. We are not responsible for third-party services or their data practices.

To the maximum extent permitted by law, Eyes Up shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or other intangible losses, resulting from your use of or inability to use the Service.

You agree to indemnify and hold harmless Eyes Up and its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

We may terminate or suspend your access to the Service at any time, with or without cause, with or without notice. Upon termination, your right to use the Service will immediately cease.

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions.
